The Illinois Charitable Trust Act http://www.illinoisattorneygeneral.gov/publications/pdf/charity.pdf 760 ILCS 55/15 and 760 ILCS 55/16 ...... make you go Hmmmmmmmmmm ...... "6 G. CONSTITUTION AND BY-LAWS The ATA is organized under the Corporate Laws of the State of Illinois and has a Illinois Charter and Corporate By-laws formulated in accordance with Illinois law, as a not-for-profit public charitable corporation. The ATA has also been recognized and approved under Internal Revenue Code (IRC) as a fully tax exempt 501(c)(3) charitable entity" ....... https://www.shootata.com/Portals/0/pdf/ata_rulebook_web.pdf 760 ILCS 55/17 ..... OH NO !!!!
There are lot of people incarcerated that have lawyers. Almost all of them. There are even lawyers in the pokey. A lawyer practicing in the State of Illinois would know better than me but Leonidas' statement implying the good guys have lawyers and the bad guys don't is silly. jmho
Rod Blagojevich went to Pepperdine University School of Law 1980-1983, he earned his JD in 1983. Juris Doctor degree ...."The degree is earned by completing law school in the United States, Canada, Australia, and other common law countries. Many who hold the degree of Juris Doctor are individuals who practice law and may choose to focus their practice on criminal law, tort, family law, corporate law, and/or a wide range of other areas. https://en.wikipedia.org/wiki/Juris_Doctor So much for the idea that knowing laws, or someone who knows laws looking something over, will prevent stupidity.
Rod Blagojevich, governor that made the deal with the EC. He also became a Cook County Assistant State's Attorney. "This is a great day. We built it and now they will come"....Blagojevich at his ribbon cutting ceremony.
"The ATA made 1.1 million in fiscal 2014. Most came from investments; the second largest contributor was the 2014 Grand American. Day-to-day operations were about a wash, expenses balancing income, as has been the case, and intention, for the last 20 years." from N1H1 post on threads/the-2015-ata-bod-meeting-results. Read that a couple of times .... "Day-to-day operations were about a wash, ....... expenses balancing income, ....... as has been the case, ....... and ... intention ..... for the last 20 years." WOW .... a "charitable entity" .... "made 1.1 million" .... most "from investments" .... and how much went to what is acceptable as a "charitable purpose" in The Illinois Charitable Trust Act ????????? If they can burn up 1.1 million, "a wash", without owning that money-pit in Illinois, just think what they can spend with owning a 'home grounds'. Can anyone find "investments" in 225 ILCS 460/15 ?????? and 225 ILCS 225 460/15 (b)(6) "and to not commingle funds with noncharitable funds and to be able to account for the funds" 760 ILCS 55/17 is a must read for some.
The ""fully tax exempt 501(c)(3) charitable entity" holds a yearly event ..... and can't find it in their hearts to have 'added money' for those who attend. Wonder what the http://www.revenue.state.il.us/LegalInformation/ has to say about this event and 'prize money' ??????????
Don't forget the feds .... https://www.irs.gov/Charities-&-Non...-Requirements-Section-501(c)(3)-Organizations "The organization must not be organized or operated for the benefit of private interests, and no part of a section 501(c)(3) organization's net earnings may inure to the benefit of any private shareholder or individual." What ???? So much to read "https://www.irs.gov/pub/irs-tege/eotopick97.pdf
That is a tough number to pick ..... it involves 'possible' State and Federal violations. Possible 'deals' with some to view the Super Secret Meeting Minutes may bring the number down, or may not. It will be interesting to see if a form 3949-A gets the ball rolling.
Leonidas, The form may bring the wrath of a gun hating government down on the whole ATA . That form could be the death knell of our organization. That must be the last resort to changing the ruling body of our sport. If they do not start explaining their actions to the members it could be the only course of action left. Roger C.
Roger, I agree with your post but wonder if just posting such nonsense wouldn't entice someone to send the form thinking they are doing some of the forum members a favor.
"nonsense" ... maybe ... just a shot across the bow to those who feel untouchable from the inside. There is always the 'nuke' option from the outside. Besides ... if they have been acting in a legal manner, that form can do no harm.
Roger I was told that Taylor resigned his x officio position from the EC. Do you or any of the others on here know if that's true? Brad
We may get to see who loves the sport of ATA Trapshooting for the sport, and who loves it for the money. How many will be willing to risk a possible "Felony" conviction for money ?????? A conviction, if it would happen, means no shotgun ownership, that would not be good if your love is for the sport, and hard to shoot without one. Who fills out the ATF Form 4473 for the gift shotgun ?????? 11.b. and 11.c. have to be "No".
Brad, I do not know. Maybe some real estate actions are bothering him. Resigning does not relieve a person of liability. This could also signal that the rats are abandoning the ship. Roger C.
MICHAEL, The first to jump is most likely the first to roll over and get a pardon to tell the whole truth. If I were the remaining members I would be a little concerened of this action. The real estate action has been uncovered. It has to cause dissention in the ranks. Roger C
I don't see any blood in the water yet. This bunch won't roll over easy when it comes to giving up their cash cow. Remember, they make all the rules for play in secrecy and if things go south there won't be any evidence laying around like the Nixon tapes.
Rumor has it that this guy might also be hired by the above famous bumbling inspector...Enter the "Dream Team" to investigate some $$$ matters of the ATA. And that their first potential witness for the prosecution might be a guy named Brad
